Yeah, but the fish was someone else's property, wasn't it (well, the school's property, but still not theirs)?
Theft and malicious mischief seem like perfectly correct charges. Since they've already both apologised and bought a replacement fish, I don't expect they'll get hit to hard by the court (though I may, of course, be wrong).
